| The Law of Guardian Council's Supervision over Election of the Islamic
Consultative Assembly |
| Article 1: |
| Before election, the Guardian Council shall elect a central supervisory committee for the election including 5 Moslem and trustworthy members with majority vote and shall introduce them to the Ministry of the Interior. |
| Note 1: |
| From 5 members of the supervisory committee at least one is required to be a member of the Guardian Council, as a Guardian council member must chair the committee. |
| Note 2: |
| The meeting of the supervisory committee shall form quorum with presence of 2/3 of the members. |
| Article 2: |
| The central supervisory committee may station his/her working place in the Ministry of the Interior to carry out his duties. The province and polling station supervisory committees may station their work place in governor general's offices. |
| Article 3: |
| The central supervisory committee shall supervise over all phases of the election processes, acts of the Ministry of the Interior with regard to the election, executive boards, recognizing the eligibility of nominees and the election performance. |
| Article 4: |
Quality of supervision over election is as follows:
A: Through reports of the Ministry of the Interior and its inspectors
B: Through dispatching of independent inspectors, if necessary, for attending to the complaints related to the executive boards and supervisors of the Ministry of the Interior. (Attending to the election complaints according to the election law of the Islamic Consultative Assembly is the duties of the central executive board of polling station.)
C- Through final attending of the complaints of files and documents of election.
D- Through appointment of supervisor in all boards relevant to election. |
| Note: |
| Supervisory committees of the Guardian Council may seek support of the government employees for supervision over election. |
| Article 5: |
The central supervisory committee of election shall establish a committee in any province consisting of 5 members with the conditions stipulated in the articles 1 and 2 for supervision over election.
The province executive boards shall inform the said committee of all the election affairs and the views of this committee in all cases related to election shall be final except the following cases:
1- Nullification or halt of election of a polling station
2- Nullification or halt of election of polling stations which affects the outcome of election.
3- Disapproval of eligibility of parliament candidates that should be approved by the central supervisory committee. |
| Note: |
| Confidential disapproval of eligibility shall be informed to the candidate in case of his/her objection (before announcement of the eligible candidates' list). Such disapproval shall be required to be confirmed by the Guardian Council. |
| Article 6: |
| The supervisory committee of the province, with agreement of the central committee shall appoint a committee consisting of 3 members with the requirements stipulated in the articles 1 and 2 for supervision over election. |
| Note: |
| In the provinces where election is delayed only in one polling station or is possible only in one polling station, appointment of the province supervisory committee shall not be necessary and the 3 member supervisory committee shall be appointed by the election central supervisory committee. |
| Article 7: |
| The 3-member supervisory committee shall appoint eligible persons stipulated in article 1 for supervision over sub-polling stations. |
| Article 8: |
Throughout the election, the central supervisory committee across the country and the 5 member committee of the provinces and the 3 member committees of election shall supervise over the election. In each case, if they observe violations, they shall report to the governor general and they shall take steps to resolve the problems according to the election law.
If the views of the supervisory committee are not considered by the officials of the Ministry of the Interior, they shall report the matter to the Guardian Council. |
| Article 9: |
| The central supervisory committee, without first expecting to receive any complaint for the election, should comment its views on the reports of the Ministry of the Interior or the supervisory committees with regards to the election. |
| Article 10: |
| The central committee shall not have the right to nullify or halt the election. They are only required to send the incorrect documents or reasons of the necessity to halt the election to the Guardian Council to take step to nullify or halt the election, if required. |
| Article 11: |
| The decision of the guardian council for nullification or halt of election shall be binding. Continuation of election in the polling stations which have been stopped by the guardian council, shall not be lawful without second comment of the guardian council and no other officials shall have right to nullify or stop the election except the guardian council. |
| Article 12: |
| Where the 3 member supervisory committee does not recognize the results of one or more polling stations consistent with law, shall report the matter along with relevant reasons to the executive board through the governor general.
Should the said executive board not approve of the view of the 3 member supervisory committee, the job shall be entrusted to the 5 member committee of the province and the view of the latter committee shall be binding. Where the supervisory committee of the province does not exist, the duty shall be entrusted to the central committee. |
| Article 13: |
| In all cases where each executive board is required to report their minutes of meetings or results to the Ministry of the Interior, they shall send a copy to the 3 member committee. In cases where signatures of the executive boards have been expected in the election law, the signature of the supervisory committee of the guardian council shall too be compulsory. |
| Article 14: |
| The required fee for supervision of the guardian council over election shall be paid from the allocated fund of election. |
| Article 15: |
| Ministry of the Interior, before issue of election instruction at any polling station, shall inform the matter to the guardian council at least one month earlier. |
| Article 16: |
| This law shall be binding from the date passed. |
